A friend’s car was repossessed during an insurance investigation, he was unable to go to work because the insurance company didn’t finish the investigation in ample enough time. The insurance company was going to give him $2500 to get the car fixed before the investigation. Now the insurance company is saying that they are going to pay him for pain & suffering and the damages to the car. Are they going to buy him a new car being as though there was no fraud?

    Your friend can clam loss of use ,and business expense and lost time. BUt he will have to prove it and his employer will have to support it. He needs to notify the adjustor now he is making a claim for personal damages.. thats what its called and find out what that adjustor wants. if they give him a hard time, contact a liability lawyer to handle the case.. youre moving into complicated areas, cause the insurer was neglectful in handling the loss and may owe damages paid on top of the property damage due to mishandling. IF your friend can prove it. Peach

    they would never actually buy him a physical vehicle but what they usually do is give him the amount his old car was worth. He needs to fight this and explain theres no way he should have to buy a used car (which is all hes going to get from what they give him) and the car he did have was a reliable vehicle so he wants an amount of money to buy a new vehicle that has the same reliability as the one he previously had. also have him get a letter as to what was happening from the insurance copany to give to the repossesion department so they repo can possibly be removed or written as falseley reported on his credit report LAUREN M

    The only reason the friends car would be repossessed is because the payments were not made and the bank wasn’t told anything. He could have rented a car, car pooled, used public transportation, or any of a number of things to get to work. He didn’t have to stay home because the insurance was investigating the loss.

    No, at best they will make up his losses and give him fair market value for the car that was stolen. Although I have to wonder how the bank found the car to repossess it.

    No. His car was repossessed because he didn’t make his payments. It was still his responsibility to make car payments even if the car wasn’t available to him. The insurance company doesn’t owe him a new car. Scott H
